NextNative.dev License Agreement

By purchasing or using the "Software" (NextNative.dev), you agree to this License Agreement:

Permissions

  • Private use of the Software is allowed.
  • Commercial use of the Software is allowed.
  • Modification of the Software is allowed.
  • Use of the Software to build and distribute unlimited end products (Applications) is allowed within the permitted scope of the license.

Limitations

  1. Starter Package:

    • Only one developer can have access to the Software.
    • Can be used for unlimited projects by the licensed developer.
    • Cannot be shared with other developers.

  2. All-in Package:

    • Multiple developers within a single organization can access the Software.
    • Can be used for unlimited projects across different departments/teams within the organization.
    • Cannot be shared with external contractors or third parties outside the organization.

Conditions

  • This license is only valid for users who have purchased the Software and possess a valid receipt from NextNative’s Official Store at https://nextnative.dev.
  • License rights are non-transferable and valid only for the original purchaser with proof of purchase.
  • Reselling, sublicensing, or redistributing the Software in its original form is not allowed.
  • Publishing the Software publicly (e.g., on public GitHub repositories or other platforms) in its original form is not allowed.
  • The Software cannot be used for any illegal or unethical purposes.
  • The Software cannot be refunded once purchased, as it is a digital product and cannot be returned once downloaded.
  • This is a perpetual license with no expiration date.
  • This agreement is governed by the laws of the State of Delaware, United States.

Examples of Use Cases

  • Allowed Use Cases:

    • Using the Software to create a mobile app for your business.
    • Using the Software to build a cross-platform app for a client.
    • Using the Software as a starting point for your project.
    • Using parts of the Software in your project.
    • Modifying the Software to fit your project’s requirements.
    • Publishing or distributing an end product (Application) created using the Software.

  • Prohibited Use Cases:

    • Purchasing a package of Software and reselling it in its original form.
    • Purchasing the Software and publishing it publicly in its original form (e.g., on a public GitHub repository).
    • Purchasing the Starter Package and sharing it with multiple developers.
    • Using the Software in a manner that violates applicable laws.

Terms of Use

  1. Definitions:

    • "Software" means the NextNative.dev software package purchased from https://nextnative.dev.
    • "Organization" means your company or entity and its members, not external contractors or partners.
    • "End Product" means any application created using the Software.

  2. Usage Terms:

    • The Software is provided in its current state.
    • Technical support is not included in the license, though guides for deploying to app stores are provided with the All-in Package.
    • Updates, bug fixes, and new features are not guaranteed but may be provided at the discretion of the owner.
    • Licensee may create and distribute end products using the Software.
    • Licensee may not use the Software in any way that violates applicable laws.

  3. Termination:

    • Your license remains valid as long as you comply with these terms.
    • Failure to comply with this agreement will result in immediate termination of the license, and you must cease all use of the Software and destroy all copies in your possession.

  4. Amendments:

    • This license is valid for the current version of the Software. The owner reserves the right to use new license terms for future versions of the Software.

  5. Intellectual Property Rights:

    • The NextNative.dev name, logo, website (https://nextnative.dev), and all other NextNative project properties remain the exclusive property of the owner.
    • This license does not grant any rights to use NextNative’s name, logo, website, or any other NextNative property.
    • Any misuse of NextNative’s intellectual property will result in immediate license termination.

🛡️ Indemnification

You agree to indemnify and hold harmless Denis Tarasenko and affiliates from any claims, damages, liabilities, or legal actions resulting from your use of the Software or violation of this agreement.

🧯 Limitation of Liability

In no event shall Denis Tarasenko be liable for any indirect, incidental, or consequential damages arising from use or inability to use the Software. Liability shall be limited to the amount paid for the license.

Governing Law

This Agreement shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts located in Delaware, United States, and you hereby consent to the personal jurisdiction and venue therein.

Disclaimer

THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHOR, THE OWNER OF NEXTNATIVE.DEV, OR ANY COPYRIGHT HOLDER BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
